Wrongful death suit decision confirmed

Joe Wheeler Electric Membership isn’t liable in the 2004 death of a man in Hartselle, the Alabama Supreme Court ruled last week.
The state’s high court upheld a decision to dismiss a wrongful death case brought against the Co-op by the family of Dominic DiBiasi. Dibiasi died Oct. 11, 2004, when he touched an uninsulated power line on top of a house while he was inspecting its gutters.
The suit alleged negligence on the part of Joe Wheeler in allowing the uninsulated power line to be located near the house.
The case had already been dismissed by Morgan County Circuit Court, a decision upheld by the Supreme Court.
